These Terms of Use (“Terms”) govern your access to and use of the Cool Mate website and mobile application (together, the “Service”) operated by Cool Mate (“we”, “us”, or “our”).

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Use of the Service

You must meet the minimum age requirement for your region to use our Service. The minimum age is 13 years in most countries, 14 years in Brazil, and 12 years in South Korea. By using the Service, you represent that you meet the applicable age requirement and that all information you provide is accurate and complete.

If you are under the age of 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms and any applicable laws and regulations.

2. Monitoring and Session Recording

We use automated session recording and error tracking tools to monitor, diagnose, and improve the Service. These tools may capture the full visual content of Your interactions with the Service, including text, images, and other on-screen elements as they appeared during Your session.

A small percentage of sessions are recorded automatically for quality assurance purposes. All sessions in which an error occurs are recorded. By using the Service, You acknowledge and consent to this recording. You may contact Us at any time to opt out of session recording.

3. User Accounts

To access certain features, you may be required to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We reserve the right to suspend or terminate your account if we believe that you have violated these Terms or engaged in any unlawful or inappropriate behavior.

4. Intellectual Property

All original content, trademarks, logos, and intellectual property on the Service are our property or that of our licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

The Service may display third-party content, including publicly available images, promotional materials, metadata, and other reference materials, solely for the purpose of identifying and contextualising educational content. Images are displayed for identification purposes only and remain the property of their respective owners. Such materials are used in a referential and informational capacity consistent with common industry practice to support the educational experience. We do not claim ownership of third-party intellectual property displayed on the Service.

5. Content and Educational Materials

The Service provides educational content and materials created, curated, or compiled by us for the purpose of language learning. This includes AI-generated content, original material produced by us, and curated reference materials. Educational content on the Service may be accompanied by instructional features such as subtitles, vocabulary highlights, comprehension exercises, or pronunciation guides.

We present all content on the Service within an educational and transformative context, designed to facilitate language acquisition and comprehension. Any third-party content displayed on the Service is used solely in support of this educational purpose.

All content provided through the Service is either owned by us, used with permission, used under applicable legal doctrines including fair use and fair dealing, or generated using artificial intelligence tools. We respect the intellectual property rights of others and will promptly remove any content upon receiving a valid takedown request from a rights holder.

If you believe that any content on the Service infringes your copyright, you may submit a takedown request to yoCoolMate+copyright@gmail.com with the following information:

• A description of the copyrighted work you claim has been infringed
• The location of the infringing material on the Service (e.g. a URL or screenshot)
• Your contact information (name, address, email, telephone number)

• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on behalf of the copyright owner

6. User Data

The Service does not currently support user-submitted or user-uploaded content. Your use of the Service generates certain data (such as learning progress and preferences) which is stored and used solely to provide and improve the Service in accordance with our Privacy Policy.

7. Payments, Subscriptions and Purchases

If you purchase any paid products or services through our Service, you agree to provide accurate billing information and authorize us to charge the applicable fees.

We offer the following plans:

Prices shown are in USD. Actual prices may vary by country and are determined by the Apple App Store and Google Play Store at the time of purchase.

When you subscribe:

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

All purchases are final unless stated otherwise. We reserve the right to change our prices or payment terms at any time. Price changes will take effect at the start of the next subscription period following the date of the price change.

8. Refunds

Refunds for subscriptions purchased through the App Store or Google Play are handled according to the respective platform's refund policies:

• Apple App Store: Request a refund at Apple Support or through your device Settings > Apple ID > Subscriptions.
• Google Play: Request a refund through the Google Play Store app or at Google Play Help.

We do not process refunds directly. All billing is managed by the respective app store platform.

9. Account Deletion

You may delete your account at any time through the app settings (Profile > Delete Account). Account deletion is permanent and will remove all associated data, including your learning progress, preferences, and profile information.

Please note that active subscriptions are not automatically cancelled when you delete your account. You must cancel your subscription through the App Store or Google Play Store before deleting your account to avoid further charges.

10. Prohibited Activities

You agree not to use the Service to:

• Engage in any illegal or fraudulent activity
• Harass, abuse, or harm others
• Transmit viruses or malicious code
• Use automated systems (bots, scrapers, etc.) without our permission
• Interfere with the integrity or security of the Service

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claims under these Terms is limited to the amount you paid (if any) for access to the Service during the past 12 months.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms.

Upon termination, all rights granted to you under these Terms will immediately cease.

14. Changes to These Terms

We may modify these Terms at any time. Changes will be effective when posted on this page with an updated “Last updated” date.

By continuing to use the Service after changes are posted, you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of London, UK.
